Magnesium Oxide Price-Fixing Case Shut Down For Now

Law360, New York (October 20, 2011, 6:35 PM EDT) -- A New Jersey federal judge on Thursday tossed price-fixing claims brought by putative classes of direct and indirect purchasers of magnesium oxide as time-barred, but said the plaintiffs could amend their complaints to argue that the statute of limitations should be tolled.

U.S. District Judge Dickinson R. Debevoise ruled that the plaintiffs' claims were prohibited by a four-year statute of limitations because they had failed to allege that overt acts had occurred after 2004 in the conspiracy, and because they had not supplied specific enough evidence...
