9th Circ. Reopens West, Kaplan Bar Prep Collusion Case

Law360, New York (November 7, 2011, 10:20 PM EST) -- The Ninth Circuit on Monday revived a class action accusing Kaplan Inc. and West Publishing Corp. of colluding in the bar exam prep business, rejecting a ruling that a previous $49 million settlement prevented the plaintiffs from bringing the suit.

In a unanimous opinion, the appeals court rejected the lower court's decision that a class of about 165,000 people who purchased West's BAR/BRI review course beginning in August 2006 were not entitled to damages or prospective relief because of the earlier settlement.
