Motorola Employees Denied Class Cert. In ERISA Suit

Law360, New York (November 15, 2011, 7:16 PM EST) -- An Illinois federal judge refused Tuesday to certify a class of Motorola Inc. employees in an Employee Retirement Income Security Act suit over an option to invest in company stock, finding the plaintiffs' claims were too variable to merit class treatment.

U.S. District Judge Samuel Der-Yeghiayan denied the employees' motion for class certification, saying that the potential class had failed to satisfy the commonality or typicality requirements for certification because their claims would vary based on the dates of their investments.
