Law360, New York (November 16, 2011, 9:37 PM EST) -- The Ninth Circuit on Wednesday stayed its ruling that veterans have a constitutional right to mental health care and timely decisions on other benefits claims, ordering a rehearing en banc of a class action against the federal government over delayed treatment of post-traumatic stress disorder.
A majority of active judges voted for the rehearing, granting a petition filed by the government in July. Oral arguments in the en banc hearing will take place during the week of Dec. 12, the court said.
