Metacafe Reaches Deal In Web Tracking Class Action

Law360, New York (November 18, 2011, 6:23 PM EST) -- Metacafe Inc. on Friday settled a class action in New York claiming the video website tracked the browsing activity of millions of its users by circumventing privacy measures and shared the users' information with a third party.

The settlement agreement, as laid out in a motion for preliminary approval filed by plaintiff Joseph Garvey, called for Metacafe to pay up to $250 per class member for expenses attributable to the company. It did not include a provision for the reimbursement of lost profits or opportunity costs....
