2nd Circ. Scraps Capital One Debt Collection Suit

Law360, New York (November 21, 2011, 4:51 PM EST) -- The Second Circuit refused Monday to revive a suit accusing Capital One Bank NA of duping customers into calling third-party bill collectors, finding the proposed class action failed to show the bank's debt collection letters violated consumer protection law.

Capital One in early 2010 sent its credit card customers a letter on company letterhead promising to reduce their interest rates to zero if they would call the bank and work out a plan to repay their outstanding balances.
