DOJ Faces Reversal Of Lindsey FCPA Victory

Law360, Los Angeles (November 29, 2011, 7:35 PM EST) -- A California federal judge tentatively ruled Tuesday to toss the Foreign Corrupt Practices Act case against Lindsey Manufacturing Co. and two of its executives on grounds of prosecutorial misconduct, saying the defendants’ due process rights had been violated.

“The basis for this ruling ultimately is that my power and my duty as an administrator of justice requires and warrants dismissal,” U.S. District Judge A. Howard Matz told prosecutors Tuesday, describing a 43-page tentative ruling dismissing the high-profile indictment.
