Toyota MDL Judge To Eye Fla., NY Economic Loss Claims

Law360, New York (December 5, 2011, 3:43 PM EST) -- The judge overseeing multidistrict litigation against Toyota Motor Corp. decided Thursday to consider tossing claims made under New York and Florida law — but not California law — related to economic harm allegedly caused by a sudden acceleration defect.

Toyota moved Nov. 30 for the dismissal of New York and Florida plaintiffs' allegations in a second amended economic loss master consolidated complaint and several individual class actions, as well as for judgment on the pleadings regarding certain California plaintiffs' allegations.
