Acosta Merchandisers Win Conditional Cert. In OT Action

Law360, New York (December 19, 2011, 4:08 PM EST) -- A California federal judge on Friday conditionally certified a class of Acosta Sales LLC merchandisers to bring claims that the marketing giant failed to pay them for time spent on required tasks performed before and after visits to clients' retail locations.

U.S. District Judge Gary A. Feess granted conditional certification to a nationwide opt-in class comprised of nonexempt employees in Acosta’s retail department who are subject to Acosta’s written overtime and commute time policies.
