DNA Probe Patent Suit Belongs In California: Fed. Circ.

Law360, New York (December 22, 2011, 7:30 PM EST) -- The Federal Circuit on Thursday said a DNA probe patent infringement proceeding would best be heard before a California federal court, saying that a Texas federal court had abused its discretion in denying a motion for transfer.

The appellate court granted a writ of mandamus for the infringement suit brought by Applied Biosystem LLC and parent Life Technologies Corp. against a trio of bioscience companies accused of co-opting five patents used in fluorescent gene material probes.
