Construction Co. Sues Army Over $38M Small Biz Set-Aside

Law360, New York (January 20, 2012, 8:33 PM EST) -- W.B. Construction and Sons Inc. filed suit in the U.S. Court of Federal Claims on Friday, alleging that the U.S. Army wrongfully awarded a $38.5 million small business set-aside contract for road and drainage construction to an ineligible offeror.

The plaintiff argues that the Army erred when it awarded the disputed 8(a) small business set-aside contract to competitor DQSI LLC, which the U.S. Small Business Administration has found to not be an 8(a)-certified concern.
