DC Comics Defends 'Superman' Discovery In 9th Circ.

Law360, Los Angeles (February 7, 2012, 8:06 PM EST) -- The Ninth Circuit on Tuesday pressed DC Comics on claims that heirs to the creators of “Superman” lost protections on documents subpoenaed by federal investigators, questioning whether its lawyers could have waived attorney-client privilege in the battle over rights to the superhero.

“The question is, where is the client's action,” Circuit Judge Alex Kozinski asked an attorney for the Warner Bros. division Monday. “The fact that a lawyer stands up and says, even explicitly, that, 'Yes, I have a waiver from the client,' that's not enough....
