Halliburton Asks 2nd Circ. To Kill ERISA Action

Law360, New York (February 14, 2012, 6:28 PM EST) -- Halliburton Co. urged the Second Circuit on Monday to uphold a New York federal court’s dismissal of a putative class action alleging the company cut pensions to employees of a subsidiary that was spun off in 2000.

In a brief, Halliburton said the lower court correctly ruled in June that the plaintiffs, employees of Dresser-Rand Co., improperly brought the suit before exhausting their options to obtain benefits from their plan administrator, as required under the Employee Retirement Income Security Act.
