Safe Auto Class Kicks Excess Coverage Suit Back To State Court

Law360, New York (February 15, 2012, 10:10 PM EST) -- A Georgia federal judge on Wednesday sent back to state court a putative class action accusing Safe Auto Insurance Co. of deceptively tacking on unrequested and unnecessary accidental death and dismemberment coverage to consumers’ basic automobile insurance policies.

In granting plaintiff Julie F. Justus’ motion to remand the suit to White County Superior Court, U.S. District Judge William C. O’Kelley found that the federal court did not have jurisdiction over the suit because the matter in controversy did not exceed $5 million exclusive of interest and...
