7th Circ. Won't Reopen Perkins Coie, Aviall ERISA Dispute

Law360, New York (March 2, 2012, 7:28 PM EST) -- The Seventh Circuit ruled Friday that Social Security disability dependent payments compensate for a disabled parent's lost wages, refusing to revive a putative class action alleging Perkins Coie LLP and Aviall Inc.'s long-term disability plans wrongly offset plan benefits based on such payments.

The appeals court affirmed an Illinois federal court's decision to dismiss the case, in which former employees sued Perkins Coie, Aviall and Prudential Life Insurance Co. of America, who issued the plans, under the Employee Retirement Income Security Act. In a 2009 complaint,...
