BofA Says Calif. Seating Rule Doesn't Apply To Tellers

Law360, New York (March 8, 2012, 5:12 PM EST) -- The dismissal of a putative class action accusing Bank of America Corp. of violating California law by forcing tellers to stand for the duration of their shifts was proper because the nature of their work requires them to stay on their feet, Bank of America told the Ninth Circuit on Wednesday.

And even if the tellers' work allowed them to sit down, they never alleged that they asked for or even wanted seats, said BofA's brief, a response to the tellers' request to revive the case...
