Motorola May Still Be On Hook Over Phone Updates

Law360, New York (March 14, 2012, 6:13 PM EDT) -- A federal judge on Wednesday dismissed a proposed class action against Motorola Mobility Inc. over its alleged failure to update the operating system for its Cliq XT smartphone as promised, but left the door open for the plaintiffs to amend their claims.

U.S. District Judge Yvonne Gonzalez Rogers, in an order granting Motorola’s motion to dismiss the case, said the plaintiffs — customers who alleged they bought the phones under the impression Motorola would upgrade the operating system — failed to adequately plead their claims....
