Apple Asks 9th Circ. To Unplug ITunes Antitrust Row

Law360, New York (March 15, 2012, 8:13 PM EDT) -- Apple Inc. on Wednesday urged the Ninth Circuit to uphold a lower court’s decision to toss a putative class action alleging Apple violated antitrust laws by encrypting iTunes songs to thwart competing services, arguing the suit’s claims were implausible and contradictory.

In its brief, Apple asked the appeals court to keep in place a California judge’s June 2011 order dismissing with prejudice the suit brought by consumer Stacie Somers on behalf of individuals who purchased music files from Apple.
