Strand Board Case Survives Motion To Dismiss

Law360, New York (August 9, 2007, 12:00 AM EDT) -- A judge ruled last Friday that the plaintiffs in a class-action lawsuit alleging price-fixing in the oriented strand board market have satisfied the pleading standard in the Supreme Court's recent Twombly decision, meaning the case will go ahead as scheduled.

In rejecting motions to dismiss filed by Weyerhaeuser, Georgia-Pacific and the other main North American producers of oriented strand board, Judge Paul S. Diamond of the U.S. District Court for the Eastern District of Pennsylvania opined that the parallel conduct alleged in the Bell Atlantic v....
