Law360, New York (March 29, 2012, 5:05 PM EDT) -- A California judge denied class certification Wednesday in a suit accusing Mercedes-Benz USA LLC of failing to notify customers about a defect in the so-called water-management system of its E-Class vehicles, saying the claims failed to meet the standards imposed last year in Wal-Mart Stores Inc. v. Dukes.
U.S. District Judge Margaret M. Morrow ruled that the class proposed by plaintiff, Mercedes owner Tigran Cholakyan, failed to meet both commonality and typicality certification standards.
