Misconduct Claims Don't Doom $2.5M OT Deal, Worker Says

Law360, New York (April 5, 2012, 1:15 PM EDT) -- A $2.5 million settlement in an overtime class action against Affinity Health Plan Inc. shouldn't be derailed by an objection from a plaintiff who said an attorney with class counsel Shulman Kessler LLP breached ethical rules, an ex-Affinity worker said Wednesday.

The reaction of the class to the settlement, which won preliminary approval in December, has been positive and demonstrates strong support, class representative Jorge Guadron said in a memorandum seeking final approval for the pact, adding that of 1,501 class members, only 16 opted out,...
