Tort Claims Act Doesn't Apply To Camp Lejeune MDL, US Says

Law360, New York (April 16, 2012, 8:28 PM EDT) -- The U.S. asked a Georgia federal judge on Monday to toss multidistrict litigation brought by service members over injuries caused by water contamination at Camp Lejeune, saying the government should not be held liable for discretionary acts or injuries sustained during military service.

The plaintiffs — all of whom are former service members who were stationed at Camp Lejeune in North Carolina, or their surviving family — claim the U.S. was negligent in disposing of chlorinated solvents and a variety of other contaminants, which seeped into the base's well water. The service members claim...
