9th Circ. Lets DC Comics See 'Superman' Docs In Rights Fight

Law360, New York (April 17, 2012, 7:14 PM EDT) -- The Ninth Circuit sided Tuesday with DC Comics in its quest to obtain documents related to its battle with the heirs of the creators of Superman for rights to the superhero, rejecting arguments that attorney-client privilege protected the material.

In denying a writ of mandamus brought by the Superman heirs, their attorney Marc Toberoff and corporate entities including Toberoff's company Pacific Pictures Corp., the appeals panel found the petitioners voluntarily turned over subpoenaed documents to federal investigators — negating any attorney-client privilege.
