Boston Scientific Loses Bid To Toss ERISA Suit

Law360 (August 28, 2007, 12:00 AM EDT) -- A federal court judge has denied Boston Scientific Corp.'s motions to toss a putative class action filed by employees who claim the medical device maker breached its fiduciary duty to administer and watch over their retirement benefits.

Judge Joseph Tauro of the U.S. District Court for the District of Massachusetts on Monday ruled that the named employees do have standing to pursue their claims under the Employee Retirement Income Security Act, even though they have already cashed in on their benefits.
