Obviousness Claim Disputed In Lens Patent Spat

Law360 (September 5, 2007, 12:00 AM EDT) -- An IP holding company that sued Bausch & Lomb Inc. and CIBA Vision Corp. in 2005 over a patent related to contact lenses has asked the court overseeing the case for summary judgment of non-obviousness.

Plaintiff Rembrandt Vision Technologies LP filed its motion for partial summary judgment of non-obviousness on Tuesday, with the U.S. District Court for the Eastern District of Texas, saying that suggestions of obviousness by a defense expert are legally inadequate and lacking in substantive analysis.
