Judge Deems Patriot Act Clause Unconstitutional

Law360, New York (September 7, 2007, 12:00 AM EDT) -- A provision in the USA Patriot Act allowing the federal government to circumvent the courts and force Internet service providers to turn over users' information is “facially unconstitutional,” a federal court judge has said.

Judge Victor Marrero of the U.S. District Court in Manhattan on Thursday sided with the American Civil Liberties Union in its challenge of the national security letters. The provision effectively gives the FBI carte-blanche to seize personal information about Internet and telephone subscribers without alerting the users or a judge.
