9th Circ. Restarts Toyota Owners' Brake Defect Case

Law360, New York (June 5, 2012, 10:05 PM EDT) -- The Ninth Circuit on Tuesday revived a putative class action against Toyota Motor Sales USA Inc. over alleged defects in Corollas and Scions, saying that a lower court wrongly denied the plaintiffs an opportunity to amend their complaint after dismissing it for lack of standing.

A three-judge panel said while a California federal court was correct in its 2010 finding that the plaintiffs had failed to allege standing, there was no reason to assume that an amended complaint would have been futile.
