Before Settling, Guidant Plaintiffs Consider Appeal

Law360, New York (September 13, 2007, 12:00 AM EDT) -- Two plaintiffs want a judge to finalize his order dismissing several of their claims against Guidant Corp. over allegedly faulty implantable heart defibrillators, so that they may pursue an appeal before deciding to join a proposed $195 million settlement of the consolidated class action.

The third-party payor plaintiffs alternatively asked the judge, in a motion filed Wednesday in the U.S. District Court for the District of Minnesota, at least to lift his stay on their motion to finalize his judgment. On July 31, the judge imposed...
