Redbox Kiosks Not Exempt From Credit Card Law, 9th Circ. Told

Law360, New York (July 11, 2012, 6:52 PM EDT) -- Consumers asked the Ninth Circuit on Monday to revive a putative class action alleging Redbox Automated Retail LLC violated California's Song-Beverly Credit Card Act by recording consumers' ZIP codes, arguing Redbox's video rental kiosks are not exempt from the law.

In an opening brief filed in the appeals court, plaintiffs Michael Mehrens and John Sinibaldi said the Song-Beverly Act, which prohibits retailers from recording customers' personal identification information during a credit card transaction, does apply to Redbox’s video rental kiosks because they count as brick-and-mortar mechanical...
