2nd Circ. Affirms GM, Others Not Liable For Exhaust Injuries

Law360, New York (July 11, 2012, 7:20 PM EDT) -- The Second Circuit on Wednesday upheld the dismissal of a suit brought by New York City bus workers targeting General Motors Corp. and other makers of buses and engines over injuries allegedly caused by exhaust fumes, saying the Clean Air Act preempted their claims.

The circuit court panel affirmed the February 2011 ruling of U.S. District Judge Paul A. Crotty, who found that the CAA expressly preempted state common law tort actions baed on companies' failure to meet federal emissions standards.
