UnitedHealth Ducks ERISA Suit Over Employee Benefits

Law360, New York (July 18, 2012, 4:01 PM EDT) -- A New York federal judge on Monday dropped UnitedHealth Group Inc. from a putative class action claiming the insurer improperly calculated benefits for members of employee health care plans United helped operate who also participated in Medicare.

U.S. District Judge Katherine B. Forrest said that named plaintiff Marianne Gates couldn't lodge claims that United violates the Employee Retirement Income Security Act by calculating benefits payable for non-Medicare services under its plans by estimating how much Medicare would pay, because Gates' former employer — investment firm AllianceBernstein...
