Insurer Says It Doesn't Owe San Diego In Gas Leak Suits

Law360, New York (July 30, 2012, 1:16 PM EDT) -- Indian Harbor Insurance Co. asked a New York federal court Friday to declare that the company has no duty to defend the city of San Diego against a trio of lawsuits over hydrogen sulfide gas leaks from the city's sewage system into homes and properties because of late notice.

The three gas leak suits, which were filed by homeowners' associations and a real estate company, claim that piping in several buildings was damaged because of gas emanating from the municipal sewer main. According to Indian Harbor,...
