Oxford Health Asks High Court To Block Class Arbitration

Law360, New York (August 3, 2012, 5:52 PM EDT) -- Oxford Health Plans LLC is urging the U.S. Supreme Court to prevent the imposition of classwide arbitration unless parties explicitly agree to such proceedings, saying the Third Circuit ignored the high court’s direction when it allowed doctors to combine their grievances over reimbursements.

The insurer, a division of UnitedHealth Group Inc., submitted its certiorari petition July 27, four months after the appeals court upheld an arbitrator’s decision to compel arbitration between the firm and a class of as many as 20,000 physicians.
