Calif. False Claims Suit Against Kmart May Head East

Law360, Los Angeles (August 6, 2012, 10:14 PM EDT) -- A Los Angeles federal judge on Monday suggested he will transfer to Illinois a False Claims Act suit alleging Kmart Corp. systematically overcharged federal and state governments for prescription drugs, saying the qui tam case has little connection with Southern California.

“I just don’t see this as being a Los Angeles case. It just isn’t,” U.S. District Judge Michael W. Fitzgerald told an attorney for qui tam plaintiff James Garbe at a hearing on Kmart’s motion to transfer venue Monday. “It’s a Midwest case.”
