Cingular, PacBell Dodge False Advertising Suit Appeal

Law360, New York (August 8, 2012, 1:57 PM EDT) -- A California appeals court on Tuesday largely upheld the dismissal of a class action alleging Cingular Wireless LLC and Pacific Bell Mobile Services misled customers about their number of usable minutes, saying the plaintiffs' allegations were not sufficient or common enough.

In the suit, first filed in 2003, lead plaintiff Diane Tucker alleged Cingular and Pacific Bell — which have since been acquired by AT&T — failed to tell consumers in advertising and promotional materials that the usable minutes in their plans would be rounded up,...
