Comcast Class Cert. Defies Dukes, Retail Group Tells High Court

Law360, New York (August 24, 2012, 4:04 PM EDT) -- A Third Circuit decision backing the certification of a class of Comcast Corp. customers in an antitrust suit conflicts with the U.S. Supreme Court's landmark Dukes decision and fails to recognize the overwhelming pressure to settle that certification can exert on companies, the Retail Litigation Center Inc. told the high court Friday.
