MBIA Can't Clear Path To BofA, Countrywide Docs In MBS Suit

Law360, New York (August 29, 2012, 6:45 PM EDT) -- A New York state judge said during a hearing Wednesday that MBIA Inc. must keep jumping through restrictive hoops to gain greater access to documents from Bank of America Corp. and its Countrywide subsidiaries in a multibillion-dollar lawsuit over MBIA-insured securitized mortgages.

Judge Eileen Bransten said that the two sides agreed long ago to a confidentiality agreement, which is based on a standardized form drafted by the New York City Bar Association, to set out how they would exchange documents during discovery. That agreement calls for...
