ERISA Driver Class Certified Against FedEx

Law360 (October 16, 2007, 12:00 AM EDT) -- An Indiana federal court judge has allowed a nationwide class of drivers to sue FedEx Ground Package System Inc. under the Employment Retirement Income Security Act for allegedly misclassifying the employees as contractors.

Chief Judge Robert L. Miller Jr. of the Northern District of Indiana on Monday granted class certification to the class of drivers who seek benefits under several FedEx plans for which they were not eligible because they were deemed independent contractors.
