2nd Circ. OKs $41M Award In Military Food Contract Row

Law360, New York (September 6, 2012, 7:04 PM EDT) -- The Second Circuit on Thursday rejected Supreme Foodservice GmbH's argument that four Agility Public Warehousing Co. KSC executives' decision to clam up after prosecutors accused Agility of fraud meant that a $41 million arbitration award in a dispute over a contract to feed U.S. troops should be overturned. 

Supreme said that the confirmation of the award, which was confirmed by a district court in December, was at odds with New York public policy barring plaintiffs from seeking affirmative relief and simultaneously refusing to testify.
