Apple Threatened With Suit Alleging IPhone Toxicity

Law360, New York (October 16, 2007, 12:00 AM EDT) -- California public interest group Center for Environmental Health has threatened to sue Apple Inc. after a Greenpeace report revealed the company’s iPhone contained phthalate esters and other toxic chemicals.

On Monday, CEH sent a letter to Apple apprising the Cupertino, Calif.-based company of its intent to sue under California’s Proposition 65, which states that products containing phthalates and other chemicals classified as “reproductive toxins” must carry a warning label. CEH said the levels of phthalates found by Greenpeace in the iPhone violate Proposition 65.
