Hyatt Can't Use AIA To Kill Last-Minute Patent Suit: Judge

Law360, New York (September 12, 2012, 7:54 PM EDT) -- A Texas federal judge said Wednesday that the America Invents Act couldn't be used to kill a multidefendant patent case filed on the eve of the law's effective date, overruling Hyatt Hotels Corp.'s protest that the complaint was just a placeholder used to avoid the new statute.

Hyatt had argued that Variant filed a threadbare, 53-defendant complaint the day the before the AIA became effective Sept. 16, then filled in the pieces by amending it later, all to dodge the patent reform law's joinder provision....
