Selective Insurance Wants Off Hook For TCPA Coverage

Law360, New York (September 19, 2012, 7:21 PM EDT) -- Selective Insurance Co. of South Carolina sued marketing company Dodson Co. LLC in Illinois federal court Wednesday, arguing that it has no duty to defend Dodson from a putative Telephone Consumer Protection Act class action because the allegations are not related to personal and advertising injury.

Asking the court to declare Selective has no duty to indemnify Dodson, the insurer claims that its business owners policy issued to Dodson in 2008 does not cover allegations in the TCPA suit accusing Dodson of illegally sending out unsolicited...
