NY Town Can Block T-Mobile Tower At Girl Scout Camp

Law360, New York (September 24, 2012, 6:36 PM EDT) -- T-Mobile USA Inc. was dealt a blow in New York federal court Friday after a judge upheld a town board's decision to deny the company's permit application to build a wireless facility on a Girl Scout camp property.

Judge Arthur D. Spatt denied T-Mobile Northeast LLC's motion for summary judgment and granted the town of Islip's own cross-motion, ruling that the town did not violate the Telecommunications Act of 1996 and the New York Civil Procedure Law and Rules with its decision to deny the permit,...
