Developer’s Google Subpoena Nixed In Blog Defamation Row

Law360, Chicago (September 26, 2012, 6:59 PM EDT) -- A New Jersey appeals court on Wednesday rejected real estate developer Somerset Development LLC's attempt to revive a subpoena demanding Google Inc. disclose the identities of blog commenters who posted allegedly defamatory statements about the business.

Affirming a lower court's ruling, the appellate panel found that the comments challenged by Somerset Development and its president, Ralph Zucker, some of which accused Zucker of hurting taxpayers, did not meet the standard of false and defamatory statements that would give the plaintiffs a cause of action.
