BofA Can't Use Dukes To Kill Class Claims In Sex Bias Suit

Law360, New York (September 27, 2012, 10:01 PM EDT) -- A New York federal judge on Thursday denied Bank of America Corp.'s bid to nix class claims in a lawsuit accusing the company of underpaying female financial advisers, saying the bank's argument that the U.S. Supreme Court's Dukes decision precluded those claims was premature.

U.S. District Judge Joseph F. Bianco denied a motion by the defendants — Bank of America, Merrill Lynch & Co. and Merrill Lynch Pierce Fenner & Smith — that sought to have the plaintiffs' class claims dismissed or stricken.
