Pfizer Says Copay Subsidies Don't Harm Benefit Funds

Law360, Chicago (October 17, 2012, 8:36 PM EDT) -- Pfizer Inc. told a New York federal judge Tuesday that health care benefit funds bringing a putative class action over its allegedly illegal copayment subsidies for prescription drugs have failed to properly allege that the copay coupon program hurt their business, and that their antitrust and racketeering claims must be axed.

Calling the benefit funds' claims "a case study in overreaching," Pfizer also argued in a memorandum lodged with its motion to dismiss that the insurers chose not to exercise any of the readily available options...
