New DuPont Herbicide MDL Deal Allows Individual Claims

Law360, New York (October 22, 2012, 4:24 PM EDT) -- DuPont Co. on Friday reached a settlement in a Pennsylvania multidistrict litigation over its now-recalled herbicide Imprelis, allowing several consumer classes to maintain individual claims against the company and still receive tree maintenance, replacements and monetary reimbursements for damage caused by the herbicide.

The plaintiffs asked a Pennsylvania federal judge to preliminarily approve their settlement and certify three proposed classes, saying that the terms of their agreement, such as their ability to collect under the proposed class settlement and maintain individual claims is a marked improvement...
