Benihana Workers Deserve Class Status In Wage Suit: Judge

Law360, New York (October 24, 2012, 2:28 PM EDT) -- A federal magistrate judge recommended Tuesday that workers at several New York restaurants owned by Benihana Inc. should be able to pursue limited New York wage claims as a class, but shot down a bid to gain access to the eateries.

Magistrate Judge James C. Francis said that the court should certify two limited subclasses of workers bringing wage statement claims and spread of hour claims against Benihana, saying these claims were “amenable to class resolution.”
