Pilgrim's Pride Sees No Early Win In Workers' ERISA Suit

Law360, New York (October 30, 2012, 4:29 PM EDT) -- A Texas federal judge on Monday denied Pilgrim’s Pride Corp.'s bid to quell an employee class action, agreeing with a magistrate that dismissal was premature without more evidence on the poultry company's responsibility for losses in its stock investment plan.

U.S. District Judge Rodney Gilstrap adopted the magistrate judge’s recommendation that both parties must discover more evidence before the litigation accusing the company of misleading employees about the company’s stock value could be dismissed.
