Daimler Wants Out Of Mercedes Gas Leak Class Action

Law360, New York (November 8, 2012, 3:06 PM EST) -- Daimler AG said Wednesday its status as Mercedes-Benz USA LLC’s parent company does not mean it’s liable in a proposed class action that alleges certain Mercedes vehicles have a defect that causes gasoline leaks, and it asked a federal judge to toss the suit.

The company said the plaintiffs’ entire case against Daimler rests on the conclusory allegation that Daimler is “concurrently responsible” because, as a parent corporation, it allegedly “directs” the activities of its subsidiary Mercedes Benz USA.
